Welcome to Food Truck Connector!

Thanks for using the Food Truck Connector service (“Services”). The Services are provided by WWW Technologies LLC, located at 4637 Greene St., San Diego CA. 92107 United States. These terms apply only to Food Truck Connector, and no other WWW Technologies LCC services or products. These terms are applicable to the individuals and businesses that subscribe to the Food Truck Connector for the purposes of marketing their food business and obtaining catering leads.

Food Truck Connector is a brand of WWW Technologies LLC, a California Limited Liability Corporation. The following phrases and words in this document refer to WWW Technologies LLC: "Food Truck Connector", "FTC", "our", and "WWW Technologies".

The terms will indicate that FTC will "inform you" of a change to a service or agreement. FTC will always inform you via the email address you have provided in your account unless stated otherwise.

The terms will refer to a "truck","food truck","trucks", "food trucks", and "subscribers". Any time these terms are used, it refers to the business that has subscribed to FTC. This business may be any type that provides mobile food services.

The terms will refer to a "generic catering request". Any time "generic catering request" is used, it refers to a catering request that does not identify a specific truck.

The terms will refer to a customer "lead". Any time "lead" is used, it refers to a catering request.

By using our Services, you are agreeing to these terms. Please read them carefully.

Using our Services

You must follow any policies made available to you within the Services.

Do not misuse our Services, for example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content that you access. You may not use content from our Services unless you obtain permission from FTC or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not FTC’s. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please do not assume that we do.

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Your FTC Account

You need an FTC account in order to use some of our Services. To protect your FTC Account, keep your password confidential. You are responsible for the activity that happens on or through your FTC Account. Try not to reuse your FTC Account password on third-party applications.

Privacy and Copyright Protection

FTC’s Privacy Policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that FTC can use such data in accordance with our Privacy Policies .

Your Content in our Services

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

For the purposes of promoting your business, we may display your social media addresses, phone, email address and other related content. FTC provides secure access to the administration of this data through our admin interface which you can access through your login. You can update, modify, and/or delete this information as you see fit. Make sure that only the data you want to expose to the general public is made available. Contact support@foodtruckconnector.com if you have any questions about how to do this.

Catering Requests

The FTC website receives catering requests. Catering requests that do not identify a specific truck or business or cuisine will be distributed dependent upon the truck or business subscription level (San Diego only), whether you have agreed to receive commissioned leads, and the city/area in which your truck/business is enrolled. These requests are referred to as general catering requests in these terms.

It is FTC's intent to distribute general catering requests to paid FTC subscribers only using a system that FTC devices that is fair to to the entity requesting the truck service and the trucks. (Note: If the city in which you subscribe does not have paid subscriptions, then all subscribed trucks will receive general catering requests with priority given to trucks that have enrolled in our commission plan). These requests, in general, will go out to all the paid subscribers in a city at the same time. FTC may utilize an algorithm for distribution of these requests that limits the amount of trucks that the general catering request is distributed to. The intent of this algorithm is to prevent flooding the customer with food truck proposals for their event, and to limit the competition for each event. This algorithm is totally at the discretion of FTC.

The FTC website may receive catering requests that identify the type of cuisine that is preferred. These requests will be distributed to all the trucks in the applicable city that have identified that they support the particular cuisine type. These requests, in general, will go out to all these trucks at the same time. FTC may utilize an algorithm for distribution of these requests that limits the amount of trucks that this type of catering request is distributed to and gives priority to trucks that have enrolled in our commission program. The intent of this algorithm is to prevent flooding the customer with food truck proposals for their event, and to limit the competition for each event. This algorithm is totally at the discretion of FTC.

The FTC website will receive catering requests that specify a truck or business. These requests will be distributed to the specified truck or business only.

In paid subscription cities, accounts that are delinquent in their payments can be terminated from receiving further catering requests.

Our Subscription Services and Service Levels

Our services are used by subscription. There are currently only two levels of service: Standard and Free . These levels may change.

All subscriptions are on a monthly basis.

All of the subscription services will have a monthly fee with the exception of the Free service. These services may change. The subscription price at each service level is at the discretion of FTC, and is charged on a monthly basis with payment at the start of the service period for the month. If the price is increased, or the services are decreased, FTC will inform you at least 30 days prior to the change.

Your FTC subscription is applicable only to your selected city or area. Separate subscriptions are required for each city your business enrolls in.

Your FTC subscription is applicable only to one truck. Separate subscriptions are required for each truck that subscribes.

Conditions specific to each of the subscription levels are discussed in the paragraphs below:

Free

The Free service has no fee. FTC is under no obligation to provide this service, and you are under no obligation to use it. FTC may enroll you in this service using public information about your business. Optionally, you may enroll your own business. The level of service under this subscription may change at any time. If you do not want your public business information exposed by FTC, contact support@foodtruckconnector.com and we will remove your business from our services.

FTC may receive catering requests that specifically request your truck while you are under a Free subscription. FTC is under no obligation to inform you of this request, but will attempt to do so using your available public contact information or contact information you have entered into your account. FTC may or may not charge you for this catering request information.

Under the Free service you may or may not have a password and administrative login to FTC. In cities where there are paid subscriptions, you will most likely not have an administrative login to our services.

Standard

The Standard service will have a monthly fee. Under this plan, general catering requests,cuisine catering requests, and requests that specifically identify your truck will be distributed by email to you and can be accessed by your administrative login to FTC.

Catering Request Distribution

Generic catering requests will be reviewed and distributed to the trucks by FTC. FTC will first evaluate the validity and commercial appeal of the request, and if considered valid and commercially viable, will move the lead to the FTC truck databases that qualify for the lead within one day of this evaluation.

FTC may use an algorithm or point system for distributing the leads. The algorithm is at the discretion of FTC and can change at any time. For paid subscriptions, the factors in the point system may include: 1) the length of time a truck has been a paid subscriber with FTC, 2)the level at which the truck has been subscribed, 3)customer reviews of the truck's performance at events associated with FTC leads. 4)The amount, expected revenue, and timing of previous generic and cuisine catering requests distributed to your truck

FTC Managed Leads

FTC and its partners will manage leads in some situations. When FTC manages leads, the lead will not be distributed to the food trucks but instead the trucks will communicate with FTC and its partners acting as a broker or middle man to the customer requiring service. In these cases, FTC will receive a fee for this service, typically from the customer. Typically, the managed leads will originate from customers who request FTC management and in all cases from customers who agree to FTC management.

Commissioned Leads

In most cities FTC will have a commissioned lead program. If a truck enrolls in this program, the truck will be given priority for FTC generic catering requests. Also, the trucks will be promoted by FTC by moving the trucks up on FTC webpages. Trucks that agree to the highest commission will receive the most promotion and the best leads. In cities with commission programs, trucks that do not participate in the commission plan may not receive leads until the commissioned trucks have reviewed the lead and rejected it.

FTC will not charge commissions on leads that are managed by FTC or its partners.

FTC can terminate the commission program at any time for any truck or any city. Trucks in the commission plan that do not communicate with FTC or the customers in an expeditious manner will be removed from the commission plan and may be removed from FTC as well. If you elect to participate in the commission plan, continued participation is at the sole discretion of FTC.

Advertising

For some cities, FTC provides an option for food trucks and others to advertise on our website. The positions of the advertisements on the FTC website are based on the amount that is bid by the customer for the ad. Higher bids will receive better locations on our websites. All FTC advertising plans are on a monthly subscription, and you may discontinue the subscription at any time. There will be no proration or refund for the current monthly period if you choose to terminate or modify your advertising services.

Coupons/Special Discounts

From time to time FTC will provide special discounted offers for our services. These special discounts are normally implemented through coupons when purchasing subscriptions or advertisements for our site. Unless otherwise stated, these special discounts apply only to the services provided by FTC at the time of purchase.If FTC adds new services after the purchase date, these may or may not apply to the services purchased under the discount program.

FTC may offer annual sales guarantees associated with its subscriptions. These offers will indicate that you will get "x" times your net payments to FTC in annual sales or you will get your money back. In these cases, the annual sales start from the date of your beginning a paid subscription to FTC, and the net payments are the total amount of payments made to FTC during the year from the start of your subscription minus any payments back to you from FTC including the sales guarantee pay back. For example, in a case where FTC is guaranteeing 3 times sales and you paid $600 to FTC for a year from the start of your subscription date but made only $1200 in sales, you will get $200 back from FTC (your sales would then equal 3 times your net payments to FTC).Similarly, if you made $900 in sales, you would get $300 back. If you made no sales, you would get your entire $600 back. In order to receive your sales guarantee pay back, you must request it via an email to support@foodtruckconnector.com within 60 days of the end of your subscription year. You must be subscribed at least one year with FTC in order to receive a sales guarantee payback.

FTC Scheduling System Accounts

If you manage properties using the FTC Scheduling system, you will need an account. These accounts are specific to schedule management and are not related to a truck account. Unless otherwise indicated, all accounts are monthly and can be cancelled at any time. There is no proration or refund for the current subscription period if the account is cancelled.

Under some management accounts, the trucks may pay fees associated with booking spots at the site(s) managed by the accounts. In this case, the trucks will be charged monthly via their credit cards attached to their truck accounts. These charges are in addition to any fees associated with the FTC truck subscription. For managers of properties that charge the trucks to take spots using the FTC system, FTC will distribute the collected credit card charges to the managers on a monthly basis subject to a separately negotiated percentage of the total collected.

Modifying and Terminating our Services

You can stop using our Services or change service level at any time. If you are under paid subscription, there will be no proration or refund for the current subscription period if you choose to terminate or downgrade your services.

We believe that you own your data, and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that Service.

Website Hosting,Design, and Maintenance

Certain FTC subscription levels may include a website hosting service for your business. If FTC is hosting your website, either under your domain name or as a subdirectory to foodtruckconnector.com, FTC will attempt to maintain the site operational at all times, but provides no service level guarantee. You are free to discontinue the website hosting service at any time. Contact support@foodtruckconnector.com if you need to discontinue our web hosting service.

FTC may at times indicate that website customization services are free or included as part of a subscription. These services are limited to minor changes to the style of the FTC websites templates or themes that are included as part of your subscription unless FTC states otherwise. These free customization services are limited to approximately one hour of customization for an FTC employee trained in the FTC web designs.

FTC owns all intellectual property rights for all FTC website content that runs or is hosted on FTC servers. This includes FTC software and data that runs on 3rd party cloud providers. This software and data cannot be used on other servers or with other applications without the express written consent of FTC.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we do not promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS, NEITHER FTC NOR ITS SUPPLIERS OR DISTRIBUTORS MAKES ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DO NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES OR THEIR RELIABILITY, AVAILABILITY OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Liability for our Services

WHEN PERMITTED BY LAW, FTC WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FTC FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT THAT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU WITH THE SERVICES AGAIN).

IN ALL CASES, FTC WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

About these Terms

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

These terms govern the relationship between FTC and you. They do not create any third party beneficiary rights.

If you do not comply with these terms and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

The laws of California, USA, excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of San Diego County, California, USA, and you and FTC consent to personal jurisdiction in those courts.

FTC respects your concerns about the use of your personal information. We believe that you should know what information about you we collect, as well as how that information is used and stored. We do not share your information with any other parties other than the information that is publicly visible on our websites. If you do not want the information made public, you can either delete the information from your account through the administation login to FTC or remove your account entirely from FTC.

FTC will collect information about you when you register to become a customer. You are required to enter an email address as a user name, and some information related to your business. FTC will make this information public on its website. If you do not want this information public, do not register.

We will not sell your location and route information that we collect during your use of our services.

Information Collected about You and Our Use of Such Information

Information Related to Your Account

We collect information about you when you register to become a customer of the FTC service. Specifically, to maintain your account we collect and store in a database your email and other business information that you enter.

We will use your email address to contact you with regard to your account, and to respond to any inquiry you submit via our website or by email. We also may use your email address from time to time to inform you about our products and services that we think will interest you, and to forward catering requests.

FTC may collect your credit card information in order to bill you for your services. FTC does not store any credit card information on our servers. All of this information is securely handled and stored by our 3rd party credit card processing company, Authorize.net.

Information Related to Your Truck Schedule - Google Calendar

We make your truck schedule and locations public if you elect to share your Google calendar user data with us. If you want us to share your calendar information, you must approve this access. We use your Google calendar data throughout our website to inform food truck customers of your schedule and location. We also may make your location public if it is made public by one of the brewers we promote, or is publicly available on the Internet. We store your Google user data calendar information in our databases. We do not share this information other than through our website.

In addition, when you visit our website our systems automatically collect your IP address and the type of browser that you use.

Other Information

We may retain any data you provide to us in an email inquiry for the purpose of tracking the types of questions we receive.

Unmanaged Catering Requests

FTC will distribute your catering requests to the trucks you specify by truck name, cuisine, or city. The trucks will negotiate with you directly for your event. FTC is not involved with this negotiation and is not involved in the transaction between you and the food truck(s). Our platform simply connects you and the food truck(s)..

Managed Requests

If you request FTC management, one of FTC partners will contact you about your event. These partners are independent businesses not affiliated with FTC. You will work with them directly. FTC is not involved in the transaction between you and the FTC partner.

In some situations, FTC partners may contact you even if you do not request management. This may occur when FTC determines that management will best facilitate the execution of your event. If you utilize the FTC partner for the event, FTC is not involved in the event transaction. The negotiation is completely between you and the FTC partner.

Privacy for Customers Requesting Food Trucks

FTC respects your concerns about the use of your personal information. We believe that you should know what information about you we collect, as well as how that information is used and stored. We do not share your information with any other parties other than the information you provide to us when filling out forms on our website. This information is used to facilate FTC efforts to get food trucks for your events.

Information Collected about You and Our Use of Such Information

Information Related to Your Account

FTC will collect information about you when you submit a catering request form through our website. You are required to enter an email address, and some information related to your event. FTC will not make this information public, but will share it with food trucks in the FTC network. If you do not want this information shared with food trucks, do not submit a catering request.

FTC will store your name and email address when you vote on your favorite trucks through the FTC website. This email address may be shared with your favorite trucks. If you do not want your name and email address shared with your favorite trucks, do not vote on your favorite trucks through FTC.

FTC maintains the information you submit to us in its database. This database is private to FTC.

We will use your email address to contact you with regard to your account, and to respond to any inquiry you submit via our website or by email. We also may use your email address from time to time to inform you about our products and services that we think will interest you
